O-Earth Movement – Terms of Use
O-Earth Movement is organised by TLJ Global Sdn Bhd.
O-Earth Movement welcomes you to its official online registration platform. References to the registration platform shall include any related applications, digital platforms and other online services operated or made available by TLJ Global Sdn Bhd in connection with O-Earth Movement (collectively, the “Site”).
These Terms of Use apply to all services made available to you through the Site, including but not limited to online registration, participation applications, programme registration, event-related communications and other services provided in connection with O-Earth Movement.
By accessing, browsing or using the Site, and/or by registering for or participating in O-Earth Movement, you acknowledge that you have read, understood and agreed to be bound by these Terms of Use.
Policies and Guidelines
Our policies and guidelines, which may be published throughout the Site, including but not limited to the Privacy Policy, Cancellation Policy, Refund Policy, Registration Terms and Conditions, Event Guidelines and Frequently Asked Questions (FAQs), shall be read together with these Terms of Use.
All such policies and guidelines form an integral part of these Terms of Use and are incorporated herein by reference.
If you do not agree to any part of these Terms of Use, please discontinue your use of the Site and do not proceed with registration or participation.
TLJ Global Sdn Bhd reserves the right to amend, modify or update these Terms of Use and the applicable policies from time to time. Any updated version will take effect upon publication on the Site unless otherwise stated.
Cancellation Policy
Cancellation of registration is subject to the applicable cancellation terms communicated at the time of registration.
Unless otherwise stated, registration fees are non-refundable for participants who fail to attend the Event without prior written notice.
Any cancellation request must be submitted through the designated registration channel or in writing to the official event contact provided on the Site.
Where a refund is applicable, the amount refundable and any applicable administrative or processing charges will be determined in accordance with the prevailing Cancellation and Refund Policies.
Refund Policy
Where a participant is entitled to a refund, TLJ Global Sdn Bhd will process the refund as soon as reasonably practicable following approval of the refund request.
The processing and crediting of the refund may take approximately 2–4 weeks, depending on the payment method, payment gateway, financial institution and applicable banking procedures.
The actual amount refunded may be subject to applicable administrative, transaction or payment processing charges, where applicable.
Where a registration or payment cannot be confirmed, any amount held or charged will be processed for release or refund in accordance with the applicable payment provider's procedures.
Participants are responsible for providing accurate payment and registration information to facilitate the refund process.
Changes or Cancellation by O-Earth Movement
TLJ Global Sdn Bhd reserves the right to make reasonable changes to the Event programme, speakers, facilitators, performers, sessions, activities, experiential journeys, journey locations or formats, schedule, venue, room allocations, transport arrangements or other operational details where necessary.
While we will endeavour to minimise changes, certain changes may be required due to operational requirements, circumstances beyond our reasonable control or other unforeseen events.
Changes to programme details, speakers, facilitators, performers, journeys, venues, transport arrangements or other operational matters will not normally entitle the purchaser to a refund, provided that the overall Event continues to be delivered.
Where a material change or cancellation of the Event occurs after registration, participants will be notified through the contact details provided during registration.
Where applicable, participants may be offered an alternative arrangement or refund in accordance with the circumstances and the applicable event policies.
TLJ Global Sdn Bhd shall not be responsible for any additional costs, expenses, losses or damages incurred by participants as a result of changes to the Event, including but not limited to travel, accommodation, transportation or other personal expenses, except where otherwise required by applicable law.
Journey Selection
Experiential journeys have limited capacities and may be allocated based on availability, suitability, safety considerations and the order in which selections are received.
Submitting a preferred journey does not guarantee placement. If a selected journey is full, changed or unavailable, TLJ Global Sdn Bhd may allocate an alternative journey where appropriate.
Some journeys may involve travel, outdoor conditions, physical activity, interaction with animals or nature, or participation at another venue. Relevant requirements and safety information will be communicated to participants before the Event or prior to participation in the relevant journey.
Registration
All registrations are subject to availability and confirmation by O-Earth Movement.
Participants are responsible for ensuring that all information submitted during registration is accurate, complete and up to date.
Where an issue with a confirmed registration arises due to an administrative or technical error attributable to the organiser, participants should contact the O-Earth Movement team promptly using the official contact details provided on the Site.
The organiser will make reasonable efforts to assist and resolve the matter where possible.
Registration confirmation, event passes, tickets, certificates or other Event entitlements are issued based on the information submitted during registration and may be subject to verification.
Youth and Student Eligibility
Where an attendee is under 18 years of age, consent from a parent or legal guardian may be required.
The Organiser may require an attendee under 18 years of age to be accompanied by a parent, legal guardian or other responsible adult for selected activities or experiential journeys.
Where applicable, eligibility for youth or student participation may be subject to verification or supporting documentation as reasonably required by the Organiser.
Payment Security
TLJ Global Sdn Bhd takes reasonable measures to protect information submitted through the online registration and payment process.
Online payments, where applicable, are processed through the designated payment gateway and may support selected credit card, debit card, online banking or other available payment methods.
Participants should ensure that all payment information provided during registration is accurate.
Where payment is made by credit or debit card, the cardholder may be required to complete verification procedures imposed by the relevant payment gateway or financial institution.
TLJ Global Sdn Bhd does not retain or have access to complete payment card information where such information is processed directly through a third-party payment gateway.
Participants are encouraged to review the applicable payment gateway's terms and privacy policy before completing an online payment.
Attendee Responsibilities
Participants and attendees are responsible for ensuring that the information provided during registration is accurate, complete and current.
Participants should review all registration details, Event information, programme schedules and applicable requirements before attending O-Earth Movement.
All attendees must:
- comply with venue rules and reasonable instructions from event personnel;
- behave respectfully towards other attendees, speakers, staff, volunteers, animals, nature and the surrounding community;
- avoid conduct that is unsafe, discriminatory, disruptive or unlawful;
- supervise any accompanying minors; and
- disclose relevant accessibility, dietary or other specific needs where assistance is requested.
If you require special assistance, accessibility arrangements, dietary considerations or other specific services, please notify the organiser through the appropriate registration channel as early as possible. While we will endeavour to accommodate reasonable requests, such arrangements are subject to availability and operational feasibility.
Participants are also responsible for complying with all applicable Event guidelines, venue rules, health and safety requirements and instructions issued by the organiser during the Event.
The Organiser may refuse entry to or remove an attendee whose conduct presents a safety risk or materially disrupts the Event. No refund will be provided where removal results from the attendee’s misconduct.
Health, Safety and Personal Responsibility
Attendees participate in the Event and any related activities or experiential journeys voluntarily and are responsible for assessing whether their participation is appropriate having regard to their personal health, physical condition and individual circumstances.
Attendees must follow all safety briefings, instructions and requirements provided by the Organiser, venue, journey operator or appointed event representatives.
Where reasonably necessary for safe participation, attendees should disclose relevant health, accessibility or other conditions to the appointed event representative.
The Organiser may restrict or decline participation in a particular activity or journey where, in its reasonable judgment, participation may present a safety risk to the attendee or others.
Nothing in these Terms of Use excludes, restricts or limits any liability that cannot lawfully be excluded, restricted or limited under applicable Malaysian law.
Our Liability
While TLJ Global Sdn Bhd endeavours to ensure that the information published on the Site and provided in connection with O-Earth Movement is accurate and up to date, we do not warrant that all information will be complete, accurate or free from errors or omissions at all times.
TLJ Global Sdn Bhd shall not be liable for any loss, damage, cost or expense arising from circumstances beyond its reasonable control.
Where applicable, TLJ Global Sdn Bhd accepts responsibility for proven acts or omissions of its employees, appointed agents, suppliers or subcontractors acting within the scope of their respective duties or contractual responsibilities.
TLJ Global Sdn Bhd shall not be liable for any loss, damage, cost or expense arising from or caused by circumstances beyond its reasonable control, including but not limited to:
- acts of God or natural disasters;
- severe weather conditions;
- fire or other major incidents;
- epidemic or pandemic;
- war or threat of war;
- terrorism or security-related incidents;
- riots, civil unrest or industrial disputes;
- governmental or regulatory actions;
- transportation disruptions;
- venue closure or restrictions;
- technical failures affecting third-party services; or
- any other unforeseen circumstances beyond the reasonable control of the organiser.
Photography and Recording
Photography, video and audio recording may take place during the Event for documentation, publicity, promotional, archival and educational purposes.
Attendees who do not wish to be intentionally photographed or filmed should notify the registration or participant-experience team.
The Organiser will take reasonable steps to respect such requests. However, incidental inclusion in crowd scenes, group photographs, background footage or other general Event coverage may not always be avoidable.
Intellectual Property
Unless otherwise stated, all content made available through the Site and in connection with O-Earth Movement, including but not limited to logos, branding, text, graphics, photographs, videos, programme materials and other content, is owned by or licensed to TLJ Global Sdn Bhd or the relevant rights holder.
Such content may not be reproduced, modified, distributed, published or commercially exploited without prior written permission from the relevant rights holder.
Privacy
Personal information submitted during registration and participation in O-Earth Movement will be handled in accordance with the applicable Privacy Policy and relevant Malaysian laws and regulations.
Participants are encouraged to review the Privacy Policy before submitting personal information through the Site.
Acceptance of Terms
By accessing the Site, completing a registration or participating in O-Earth Movement, you acknowledge that you have read, understood and agreed to these Terms of Use and the applicable policies and guidelines.
These Terms of Use, together with the applicable policies and guidelines, constitute the agreement between you and TLJ Global Sdn Bhd in relation to your use of the Site and participation in O-Earth Movement, unless otherwise expressly stated.
TLJ Global Sdn Bhd reserves the right to amend these Terms of Use from time to time. Any amendments will be effective upon publication on the Site or through other official event communication channels.
